Toyota announced on Friday that it will recall around 17,000 Lexus vehicles in response to risks of the fuel tank in the cars leaking after a collision.

The Lexus HS 250h model was subjected to the recall following a US National Highway Traffic Safety Administration (NHTSA) investigation. Despite previously passing Toyota safety inspections, the conclusions of an NHTSA sub-contracted investigator were that; when the vehicles in question collided with an object at more than fifty-miles-per hour, more than 142 grams of fuel, the maximum allowed by US law, leaked from the crashed car.

According to Toyota, further tests did not show any additional failure of the fuel tank.

In response to the findings, Toyota issued a recall of all affected vehicles, since the company had no solution immediately available. The recall includes 13,000 cars already sold, as well as another 4,000 still at dealerships.

Toyota says it plans to conduct further tests to determine the cause of the leak. A Toyota spokesman, Brian Lyons, said that the company was “still working to determine what the root cause of the condition is.” It’s still unclear when exactly the recall will take place, or when dealerships will be allowed to sell this model again. Lyons said that Toyota is “working feverishly to get this resolved as soon as possible.”

Toyota isn’t aware of any accidents stemming from the leaking fuel tank in the affected vehicles, first introduced in the summer of 2009.

The Democratic Unionist Party (DUP) First Minister of Northern Ireland Paul Givan resigned effective midnight Friday as part of his party’s protests against checks on goods coming from Great Britain.

The checking provision was introduced as part of the Northern Ireland Protocol, which was decided during Brexit negotiations that saw the UK leave the European Union. However, prominent Unionists in Northern Ireland have strongly opposed its terms.

Givan’s resignation will also force Sinn Féin Deputy First Minister Michelle O’Neill from office in the devolved Executive (Stormont). This cripples the body’s legislative power, meaning it can no longer meet to pass vital policies like the three-year budget, an energy bills grant and relaxing Covid-19 restrictions. However, other Stormont ministers remain in portfolio until the next elections scheduled for May.

Givan’s emotional press statement indicated Northern Ireland’s institutions are “being tested once again and the delicate balance created by the Belfast and St Andrew’s agreements has been impacted by the agreement made by the United Kingdom government and the European Union [Brexit]”. He specifically mentioned the “cornerstone” principle of consent provided as part of the Belfast Good Friday Agreement that introduced the power-sharing Executive.

However, he emphasised his “earnest desire that all sections of the community will soon be able to give consent to the restoration of a fully functioning executive, through a resolution to the issues that have regrettably brought us to this point”.

He called his resignation after almost eight months in the post “the end of what has been the privilege of my lifetime – to serve as the First Minister of Northern Ireland”. He succeeded Arlene Foster after she resigned in June 2021. It was something “I never expected to have the opportunity to [do]” when first elected as Lagan Valley MLA in 2011, he added.

The decision was criticised by opposition parties, including “reckless and self-serving” by Sinn Féin finance minister Conor Murphy, in addition to officials in the British and Irish governments. Leader of Sinn Féin Mary Lou McDonald urged an early election to be called “in the absence of a functioning Executive” to show “the DUP actions have consequences, real consequences for people struggling”. Leader of the Ulster Unionist Party Doug Beattie framed it as destabilising, generating “more hardship for the people of Northern Ireland” and ultimately fruitless: “At the end of it all, the Protocol will still be there”.

While McDonald criticised coming inaction on the budget and healthcare investment for “the DUPs own narrow and self-serving political interests”, others expressed concern over the crippling of government services. UK Secretary of State for Northern Ireland Brandon Lewis called the move “extremely disappointing” and urged a reinstatement to “ensure the necessary delivery of public services for the citizens of Northern Ireland”. Prime Minister Boris Johnson emphasised the UK government’s priority “for a resilient Northern Ireland Executive”.

Taoiseach of Ireland Michéal Martin called Givan’s decision “a highly damaging move”. Through a spokesperson he warned “[i]t is absolutely vital for peace and prosperity in Northern Ireland that the Executive is delivering for the people of Northern Ireland, particularly now as we emerge from the Covid pandemic”. He urged “the DUP to return to full engagement with all the institutions of the Good Friday Agreement” that the Protocol protects “in all its dimensions”.

He added talks between the UK and EU, of which Ireland is a member, are ongoing and “must be given every chance to succeed”. He further said: “The [European] Commission has put forward serious proposals which directly address the concerns about outstanding issues on implementation of the Protocol”. Givan had told reporters he was resigning as Unionists were being required “to be seen and not heard” regarding the Protocol.

British Foreign Secretary Liz Truss and Commission vice president Maroš Šef?ovi? met via video conference on Thursday to discuss the Protocol, “the only solution we have found with the UK government to protect the Good Friday (Belfast) Agreement”. In a statement, Šef?ovi? called yesterday’s instruction by Stormont Agriculture Minister and former DUP leader Edwin Poots to suspend certain checks for goods entering Northern Ireland “very unhelpful”. Truss and Šef?ovi? will meet again on February 11.

Unionist politicians have made their position on the Protocol clear. Following Givan’s resignation, DUP party leader Sir Jeffrey Donaldson said it “represents an existential threat to the future of Northern Ireland’s place within the Union”. He added the UK government has not held up the New Decade, New Approach agreement that was the basis for the DUP re-entering the Executive in January 2020. The deal ended a three-year impasse in power-sharing between Sinn Féin and the DUP following the Renewable Heat Incentive scandal.

The Irish Independent understands the statement and time of Givan’s resignation was confirmed in a meeting between high-ranking DUP members earlier on Thursday.

Poots’s decision to suspend sanitary and phytosanitary checks not imposed by December 31, 2020 allegedly followed legal advice which “concluded that I can direct the checks to cease in the absence of Executive approval”. Although the UK government has said it will not intervene in a “matter for the Northern Ireland Executive”, it faced criticism as “a breach of international law” by Irish Minister for Foreign Affairs Simon Coveney. Šef?ovi? called it as “essential” that checks are still being conducted, while a spokesperson on Johnson’s behalf expressed support for “a swift resolution.”

Media reports indicate Brian Loncar, a prominent attorney based in Dallas, Texas was found unresponsive in a car outside his office Sunday morning.

Loncar was transported to a local hospital where he was pronounced dead a short time later. He was found in the front seat of his Rolls Royce Wraith. Loncar’s death occurred just two days following his teenage daughter’s memorial service. His daughter took her own life in late November.

Police are still investigating Loncar’s cause of death. Medical personnel surmised heart attack was the likely cause, according to Loncar’s son. In 2008 Loncar’s car was struck by a fire-rescue truck, seriously injuring him.

Loncar maintained eleven law offices stretching across Texas and his TV commercials featured an illustrated ‘strong arm’ pounding against steel, promising potential clients he’d help them gain compensation if they’d been injured in an accident. The law firm’s web site indicates they specialize in all types of vehicle accidents and various types of wrongful death cases.

The 7th Taipei International Hardware & DIY Show, organized by Kaigo Taiwan (The representative of Koelnmesse in Taiwan) and Koelnmesse GmbH, started on October 18-20 at Taipei World Trade Center Exhibition Hall 3. This show has 183 participants using 300 booths to exhibit accessories and tools on esoteric fabricating, home-living applications, and security.

With people in Taiwan valuing on the quality of home-living, the organizer set a pre-show pavilion of “2008 Taipei Home & Lifestyle Fair” and invited B&Q & HomeBox holding DIY workshops for visitors.

Venezuela’s government has opened a granite processing plant in the state of Bolívar, with the intention of providing about 25% of the granite required nationwide.

Ricardo Menéndez, vice president of the Productive Economic Area, said Venezuelan President Hugo Chávez has yearned for the creation of this project to empower Venezuelan construction. Granito Bolívar is reportedly the most modern Venezuelan granite plant, not consuming community water or electricity, and is also the largest, with a daily capacity to supply enough material for use in construction of about 820 houses.

Menéndez said, “These granite blocks are the natural resources of our country, are the wealth we have as a country and often [some] simply decided to remove this richness from our country and take them to other countries” ^{((es))Spanish language: ?Esos bloques de granito son la riquezas naturales de nuestro país, son las riquezas que tenemos como patria y que muchas veces sencillamente esas riquezas decidieron sacarlas de nuestro territorio nacional y llevarlas a otros países}.

For the construction of the plant, supplied by 23 quarries, the government of Bolívar provided about 30 million bolívares (US$4.7 million) and the national government €2.3 million (US$3 million). Bolívar reportedly has reserves of about 40,000 million tons of red, black, pink and white granite, sufficient for domestic demand for 200 years.

Buffalo, New York —In an unanimous vote, the City of Buffalo‘s Planning Board voted to table the Elmwood Village hotel Proposal, postponing voting on legislation for up to 30 days.

The Board said its decision was due to the lack of public involvement, saying that there have not been enough meetings.

The Elmwood Village Hotel is a proposed project by Savarino Construction Services Corporation and was designed by Karl Frizlen of The Frizlen Group. The hotel would be placed on Elmwood and Forest Avenues in Buffalo, New York. In order for the hotel to be built, at least five buildings, that include both businesses and residents, must be demolished.

The Forever Elmwood Corp. is a Buffalo-based non-profit organization founded in 1994. Justin Azzarella, the Executive Director for the organization voiced support for the proposal, stating: “I am here today to lend Forever Elmwood’s support the hotel project. Particularly, Forever Elmwood is encouraged by the fact that this building follows the more stringent Elmwood Village Design Guidelines. We have been speaking with Savarino Construction, and they have promised us [Forever Elmwood] that they will engage the community further, including the surrounding Block Clubs and businesses. For that reason, while Forever Elmwood is in support of this project and the type of project that it is, we are asking also that the project be tabled so that the community can be further engaged. Specifically the surrounding Block clubs which include the Granger, Claremont, Asland and The Lincoln Parkway Block Clubs.”

“Because of the excellent work that Karl does and the game plan that they have, I think its an ideal use of this particular location. I think that this particular type of development needs to be encouraged and promoted as opposed to roadblocked,” said a man who owns five properties near the proposal site.

However, Evelyn Bencinich, a resident of Granger Place and whose house would be located directly behind the hotel said, “My property value will be depreciated or non-existent because no one is going to want to live behind a multi-story hotel. We are facing up to a year of noisy and dangerous demolition and construction. Children, pets and even drunk rebellers could wander on site and get hurt. Traffic tie-ups caused by large machinery and garbage bins is inevitable. Where will pedestrians walk? We could experience increased unsanitary flooding in our yards and basements due to the digging and cementing for the underground parking garage. Rats will be displaced into the immediate neighborhoods and be in great abundance. Once we get past the year of nightmare construction, what if you build it and they don’t come? We could ultimately have a seven million dollar rooming house on our corner.”

Patty Morris, co-owner of Don Apparel with Nancy Pollina at 1119 Elmwood also asked that the project be tabled saying, “this has only been public knowledge for less than two weeks and the public never saw the redesign. How can you vote on anything that no one has seen yet? The Board cut off Morris saying, “so specifically you don’t have any problem with it [the design] you just…” Morris then said, “Oh I am totally against this project, but thats besides the point isn’t it.”

The planning board is also concerned that the current design may still be too big.

At one point Board member Susan Curran Hoyt said, “we know you’ve cut down your number of rooms on this project, but we still see it doesn’t seem to fit the description of a ‘botique’ hotel,” and asked Eva Hassett, Vice President of Savarino Construction, “we wonder if you could reduce the rooms further.”

“One thing I didn’t talk about was the price levels of these rooms and that will be important to know. The room rate will be somewhere between US$120 and $160 a night, which is about the same price of the Hampton Inn down town and the smaller you make the hotel, the more expensive the rooms will get. We believe that we’ve made a good compromise in terms of the size of the hotel and perhaps botique means different things to different people,” said Hassett.

The board was also concerned that there is not enough parking asking, “are there alternative plans for valet parking off-site, in the event that you have a full hotel or a large event going on?”

“We are exploring several possibilities with respect to additional parking for valet and parking near-by,” replied Hassett. “We are also exploring the possibility of using the rear of 1105 Elmwood for additional parking, which would give us an additional ten or eleven spaces.”

The new design has a total of 55 parking spaces for 72 rooms, with 39 of them underground and the rest on ground level.

Hassett also said that a “parking study” will be done on the area.

Concerns that the second floor of the hotel will be too close to the property of 605 Forest were also brought up. The board asked how far the hotel would be from the property and Karl Frizlen replied saying it would “be approximately five feet from the property line,” but he also admitted that, “I do not know exactly how close the house next door” will be from the hotel, but did say “I think the house is about four or five feet away from the property line and we [the hotel] sit right on the property line.”

The board is concerned the setback from the property is not enough saying the space between the building and the hotel is “pretty narrow.”

The City’s Common Council also agreed to table the proposal also citing the need for more public engagement and the need for more organizations to respond including the Buffalo Preservation Board and the Office of Historic Preservation.

During that meeting, Hassett also said the proposal to try and get a variance to obtain the properties of 605 and 607 Forest were “now off the agenda.”

The Common Council is expected to meet and hold a public hearing about the project and the rezoning of the properties to be demolished (1119-1121 Elmwood) on Tuesday March 7, 2006 at 2:00 p.m. in Council Chambers at City Hall. At the moment the properties are not zoned for a hotel.

At about 15:30 local time (1430 UTC) on Tuesday a fire was reported in the “Kiss & Fly” section of a parking structure at Stavanger Airport, Sola in Norway. The structure has over 3000 parking spaces; reports said more than half of those were filled. The airport was quickly closed to air traffic.

It was initially reported the fire started in an electric vehicle, but news broadcaster NRK later reported the fire started in a recalled 2005 Opel Zafira. The car was recalled after a similar fire in Cork, Ireland in August last year, causing damage to about 60 cars. Police said they questioned the car’s owner.

The fire produced heavy smoke, and local officials said there was danger the building might collapse. Nils-Erik Haagenrud of Rogaland Fire and Rescue said late on Tuesday no personnel would be sent into the building. Rogaland Fire and Rescue requested support and equipment from other fire departments. The airport and nearby hotel were both evacuated and local police warned people in the general vicinity to stay inside and close exterior vents and windows. Through Tuesday evening the fire was reduced and the order for a fire extinguisher robot from Oslo Fire and Rescue was canceled.

The airport closure also led to Norwegian Prime Minister Erna Solberg being stranded after a visit to the Johan Sverdrup oil field. Solberg posted on Twitter asking for places to eat for the seven hour drive from Stavanger to the capital of Oslo.

Reports as of Wednesday said an estimated two to three hundred vehicles had been damaged or destroyed, but no humans had been hurt.

By about 22:00 local time (2100 UTC) on Tuesday the flames were under control. Local firefighters planned to continue to monitor the situation and work to prevent further damage. It was also discovered the structure was built without sprinklers. Stavanger Airport, Sola was to open on Wednesday morning, but returning to normal service was expected to take longer. Affected travelers were advised to contact their airlines for rebooking.

Thousands of people across Australia are taking part in protests calling on the Federal Government to ratify the Kyoto Protocol. The ‘Walk Against Warming’ is part of an international day of action in 40 countries, coinciding with the United Nations climate change talks in Montreal, Quebec, Canada.

According to the Walk Against Warming group, “the need to reduce greenhouse gases is at crisis point, we must act now for the sustainability of our planet for future generations.”

Melinda Cook, Nature Conservation Council of New South Wales official, says governments need to take much stronger action on the issue of Climate Change.

“This international day has been called to put pressure on Australia and the US to ratify and to make sure governments are aware that the community is demanding serious commitments and action on greenhouse gas reduction,” said Cook.

Siding with the United States, the Australian Federal Government has refused to ratify the Kyoto Protocol on climate change, arguing it is damaging to their economic interests. Federal Environment Minister Ian Campbell says Australia is focused on measures that should be taken after Kyoto expires in 2012.

“We need to do something that suits the developed world, something that suits the rapidly developing world, partnerships, technologies, economic mechanisms that drive us towards that,” said Campbell. “We’re nowhere near that at the moment and Australia wants to be a constructive part of driving us towards a very useful post-Kyoto regime.”

Protesters across Australia are using the International Day of Action on Climate Change to demand the government adopt a clean energy policy. Hundreds of people marched through Sydney on Saturday to mark the day.

The protest against global warming coincides with the 12-day conference in Montreal, which will discuss climate change measures and future international action when the Kyoto Protocol expires at the end of 2012. Australia and the United States are the only western industrialised nations which refuse to ratify the global Kyoto Protocol. Australia has delegates at the Montreal meeting, but will only act as observers.

Melinda Cook said scientists had predicted huge negative consequences including extreme weather and even social and economic impacts if steps were not taken now. Cook also said governments must make a “serious commitment” not to build any more coal fire powered stations.

The United States Bush administration and the Australian Howard Government have refused to ratify the Kyoto agreement, which pledges industrialised nations to cut carbon dioxide levels to 5.2 per cent below 1990 levels between 2008 and 2012.

Global Action

Up to a million people will take to the streets of more than 100 cities across dozens of countries today to demand greater action on global warming. Organizers of the protests say the world’s leading industrialised nations had failed to make an impact on climate change and some, in particular Britain, were backsliding on their environmental commitments.

The United Nations meeting in Montreal, will be attended by representatives of 189 countries. The centerpiece of the International Day of Climate Protest will be a mass protest in Montreal, where at least 15,000 people are expected to lobby delegates.

Across the planet, protests are being held in locations from Helsinki to Seoul. In Washington, drivers of fuel-efficient hybrid cars will rally around the White House. In New Orleans – devastated by Hurricane Katrina in August – there will be a “Stop Global Warming” street party in the French Quarter.

“There is probably very little we can expect [from Montreal] because we are doing nothing to keep fossil fuel in the ground. All these techno-fixes are a waste of time if we continue to burn fossil fuel at the same rate,” said George Monbiot, an academic and environment commentator, who will address a rally in London.

“There is a lot of cynicism about what the British government is doing. [Prime Minister] Tony Blair has promised much and persuaded many that he will deliver but it has turned out to be rubbish. Blair had no intention of doing anything on climate change other than talk about it. But this weekend’s protests are taking place in a changed context – the media are listening and finally we have to make the politicians listen.”

Detroit Red Wings defenseman Jiri Fischer was hospitalized Monday night after suffering a seizure while on the bench during an ice hockey game in Detroit. He is listed in stable condition.

Late in the first period in a game against the Nashville Predators at Joe Louis Arena, Fischer collapsed on the bench. According to Red Wing coach Mike Babcock, Fischer suffered a seizure, and went into cardiac arrest. He was revived by team medical staff, who used a defibrillator to restart Fischer’s heart. He was taken by ambulance to Detroit Receiving Hospital. Fox Sports Detroit reported that he was awake and talking to hospital staff.

As of Monday night, Fischer’s condition was listed as stable.

In September 2002, Fischer had an abnormal electrocardiogram reading, forcing him to miss two days of training camp. A subsequent follow-up test was passed.

The game, which was officially stopped with 7:30 left in the first period, was cancelled. The game will be made up on January 23, 2006.

Construction workers and next of kin of deceased workers filed a lawsuit in Tokyo, Japan Friday seeking damages of approximately 6.6 billion yen (about US$64 million) from the government and manufacturers related to illnesses stemming from exposure to asbestos. 178 plaintiffs; including construction workers and family members filed the suit in Tokyo District Court against 46 building manufacturers and the Government of Japan.

According to the Mainichi Daily News, the class action suit is the first that has been filed in Japan related to health damages caused by asbestos exposure at construction sites. The plaintiffs hail from the Japanese prefectures of Tokyo, Saitama and Chiba.

The plaintiffs claim that the government and manufacturers knew of the dangers of asbestos inhalation but failed to take proper precautions, including ceasing to promote asbestos as a cheap fire retardant and banning production of the material.

They state that after inhaling asbestos in the workplace, 172 people have developed lung cancer or mesothelioma, and that almost half of those afflicted are now dead. Plaintiffs argue that the government and health ministry did not act quickly enough after international organizations issued warnings in 1972 that asbestos could be a carcinogen.

Plaintiffs also place blame with the Ministry of Economy, Trade and Industry for sanctioning the use of asbestos under Japanese Industrial Standards, and with the Ministry of Land, Infrastructure and Transport for approving the use of materials comprised of asbestos and other substances under Japan’s Building Standards Law.

“We will do our utmost until we win the suit,” said Kazuo Miyajima, 78, who heads the group of plaintiffs. Lawyers for the plaintiffs released a statement saying: “We seek complete relief for the victims by clarifying the liability of the state and the manufacturers.”

Approximately 40 construction workers from Kanagawa Prefecture plan to file a similar lawsuit in June in Yokohama District Court.

After a 2005 revelation that residents who lived near a factory in Amagasaki, Hyogo Prefecture developed diseases related to asbestos, the government implemented a law in 2006 which provides monetary assistance to asbestos victims and relatives of deceased family members. The plaintiffs argue that the amount of financial assistance given to families and victims of asbestos-related diseases is not sufficient.

Asbestos has been used in Japan as a fire retardant, for sound absorption, and for insulation. It was mixed in concrete and water and sprayed on walls and ceilings, but the practice of spraying asbestos in this manner was banned in Japan in 1975.
